By accessing this website, submitting an enquiry, requesting a quotation, or entering into a rental agreement with Sumo Technologies, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.
1. Who We Are
Sumo Technologies is an IT equipment rental company providing rental solutions for businesses, startups, educational institutions, corporate events, and organizations across India. Our rental offerings include laptops, MacBooks, desktops, workstations, servers, networking equipment, AV equipment, printers, and related IT infrastructure, available across Bangalore, Chennai, Hyderabad, Pune, and other locations we serve.
These Terms and Conditions apply to all enquiries, quotations, and rental agreements made through our website, phone, WhatsApp, or in person.
2. Definitions
- “Company,” “we,” “us,” “our” refers to Sumo Technologies.
- “Customer,” “you,” “your” refers to the individual or business entering into a rental agreement.
- “Equipment” refers to any IT hardware rented under these terms, including laptops, MacBooks, desktops, workstations, servers, networking equipment, printers, and AV equipment.
- “Rental Period” refers to the agreed duration of the rental, as specified in the rental agreement or quotation.
- “Rental Agreement” refers to the specific order confirmation, quotation, or contract governing an individual rental.
3. Eligibility and Account Verification
1. Our rental services are intended primarily for registered businesses, startups, institutions, and organizations. Individual rentals may be accepted at our discretion.
2. To confirm a rental, business customers must provide:
- Company Incorporation Certificate
- GST registration
- PAN
3. Individual customers must provide:
- Government-issued photo ID
- Address proof
4. KYC verification is conducted digitally. We reserve the right to decline a rental request if verification cannot be completed satisfactorily.
5. All information provided must be accurate and current. Providing false or misleading information may result in immediate termination of the rental agreement.
4. Quotations and Pricing
1. All quotations are valid for the period stated in the quotation document.
2. Pricing depends on equipment type, configuration, rental duration, and order volume. Bulk orders may qualify for discounted rates.
3. All prices are exclusive of applicable taxes unless stated otherwise. GST is charged as per applicable rates and reflected in the final invoice.
4. We reserve the right to revise pricing for renewals or extensions, subject to reasonable prior notice.
5. Payment Terms
1. Rental invoices are issued in accordance with the payment schedule specified in the rental agreement (e.g., monthly in advance, upfront for short-term rentals).
2. Specify late payment consequences: interest/penalty rate on overdue amounts, and the Company’s right to suspend service or repossess equipment for non-payment.
3. All payments must be made through the methods specified in the invoice. Bank charges, if any, for payment processing are borne by the Customer unless otherwise agreed.
6. Delivery and Installation
1. Delivery timelines are estimated at the time of quotation and confirmed based on equipment availability, order size, and delivery location.
2. The Company will make reasonable efforts to meet stated delivery timelines but is not liable for delays caused by circumstances beyond its reasonable control (see Section 16, Force Majeure).
3. Equipment is delivered, configured and tested as agreed in the quotation. The Customer should inspect equipment upon delivery and report any visible damage or discrepancy within 24 hours of receipt.
4. Onsite installation, where included, will be carried out by Company personnel or authorized representatives.
7. Customer Responsibilities During the Rental Period
1. The Customer agrees to:
- Use the Equipment only for lawful business purposes
- Keep the Equipment in good working condition
- Not modify, disassemble, or attempt unauthorized repairs on the Equipment
- Not sublease, resell, or transfer the Equipment to any third party without the Company’s written consent
- Ensure the Equipment is used in a suitable environment (e.g., appropriate power supply, climate conditions)
- Notify the Company promptly of any malfunction, damage, or loss
2. The Customer is responsible for backing up and securing any data placed on rented Equipment during the rental period. The Company is not liable for any loss of Customer data, except where such loss results from the Company’s gross negligence.
8. Ownership of Equipment
1. All Equipment remains the sole property of Sumo Technologies at all times during the rental period. The Customer obtains no ownership rights, title, or interest in the Equipment.
2. The Customer must not represent the Equipment as owned, pledge it as collateral, or allow it to become subject to any lien or encumbrance.
9. Maintenance, Faults, and Replacement
1. In the event of a hardware fault arising from normal use, the Company will provide a free replacement, subject to the replacement timelines communicated at the time of quotation (commonly same-day or within 24 hours, depending on location and equipment type).
2. Faults arising from misuse, negligence, unauthorized modification, or use outside the Equipment’s specifications are not covered under this replacement policy and may be chargeable to the Customer.
3. Routine maintenance, where included in the rental plan, will be carried out by Company personnel. The Customer must provide reasonable access for scheduled maintenance.
10. Damage, Loss, and Theft
1. The Customer is responsible for the Equipment from the time of delivery until the time of return or collection by the Company.
- Accidental damage: where an optional damage/insurance add-on has been purchased, covered damage is handled as per the terms of that add-on, up to the threshold specified in the rental agreement. Where no such add-on applies, the Customer is liable for repair or replacement cost at the Company’s discretion.
- Loss or theft: the Customer must report loss or theft to the Company and to local police authorities within X hours/days of discovery. The Customer is liable for the full replacement value of lost or stolen Equipment unless covered under an applicable insurance add-on.
- Deliberate damage or misuse is not covered under any circumstances and is chargeable in full to the Customer.
2. The security deposit may be applied toward any amounts owed under this section, with the Customer liable for any shortfall.
11. Data Security and Data Wipe
1. Upon return, all Equipment undergoes certified data sanitization to remove any Customer data, software, or configurations.
2. The Customer remains responsible for removing or backing up sensitive data prior to return. The Company is not liable for data left on Equipment at the time of return, though standard data wipe procedures will still be followed.
12. Rental Duration, Renewal, and Extension
1. The Rental Period begins on the date of delivery and continues for the duration specified in the rental agreement.
2. Monthly rentals may be extended on a rolling basis unless cancelled with the notice period specified in the rental agreement (commonly 30 days).
3. Long-term leases (annual or multi-year) are governed by the specific terms, including any minimum commitment period, set out in the individual lease agreement.
13. Cancellation and Early Termination
1.Specify:
- Notice period required for cancellation of ongoing (monthly) rentals
- Any early termination fees applicable to fixed-term or long-term leases
- Refund policy, if any, for prepaid amounts upon cancellation
2. The Company reserves the right to terminate a rental agreement immediately, without refund of prepaid amounts, in cases of:
- Non-payment
- Misuse of Equipment
- Breach of these Terms and Conditions
- Provision of false information during KYC verification
14. Return of Equipment
1. Upon completion or termination of the Rental Period, the Customer must make the Equipment available for collection or return it as instructed by the Company.
2. Equipment must be returned in the same condition as delivered, subject to normal wear and tear.
3. Specify late return charges (e.g., a daily rate continuing to apply until Equipment is returned) and the process if a Customer fails to return Equipment after repeated requests.
15. Force Majeure
The Company shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from circumstances beyond its reasonable control, including but not limited to natural disasters, floods, strikes, government restrictions, pandemics, power outages, or supply chain disruptions.
16. Limitation of Liability
1. To the maximum extent permitted by applicable law, the Company’s total liability under any rental agreement shall not exceed the total rental fees paid by the Customer for the affected Equipment / a specified cap.
2. The Company shall not be liable for any indirect, incidental, consequential, or special damages, including loss of business, loss of data, or loss of profits, arising from the use of or inability to use the Equipment.
17. Indemnification
The Customer agrees to indemnify and hold the Company harmless from any claims, damages, losses, or expenses arising from the Customer’s misuse of the Equipment, breach of these Terms, or violation of applicable law in connection with the Equipment’s use.
18. Privacy
Any personal or business information collected in connection with a rental agreement is handled in accordance with our Privacy Policy.
19. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in specific city, likely wherever the Company’s registered office is located.
20. Amendments
The Company reserves the right to modify these Terms and Conditions at any time. Updated terms will be published on this page with a revised effective date. Continued use of our services after such changes constitutes acceptance of the revised Terms.
